Terms & Conditions of Service – Courier Express

- The rate Excludes VAT.
- Rates are calculated based on applicable transportation and do not include: surcharges, ancillary / other charges, duties and taxes, or special handling fees.
- INTERMAR reserves the right to change pricing at any time.
- If Any changes in number of pieces, weight or dimensions or postal code rate will be change.

Definitions:
1 Company: Refers to Courier Express including its offices, agents, and subcontractors.
2 Client: The sender, receiver, or any party requesting services.
3 Shipment: Any parcel, documents, goods, or materials transported by the Company.
4 Air Waybill / Bill of Lading: The document stating shipment details and,
   forming an integral part of these Terms & Conditions.
Scope of Service:
1 The Company provides air, sea, land, and express courier services internationally.
2 The Company may engage third-party carriers or agents without prior notice to the Client.
Client Responsibilities:
1 Accuracy of Information
2 Client must provide complete and correct shipment details, including content description,
   value, sender/receiver information, and required customs documents.
3 Packaging
4 The Client is responsible for proper packaging to withstand normal handling and transportation.
5 The Company is not liable for damage caused by inadequate or improper packaging.
Prohibited Items:
The Client must not ship items such as:
1 Hazardous goods, explosives, flammable substances
2 Cash, precious metals, jewelry, or high-value cargo without prior written approval
3 Illegal goods or items violating customs, import/export, or intellectual property laws
Company Responsibilities
1 Standard of Care
- The Company will exercise reasonable care in handling and transporting shipments.
- The Company is not liable for loss or damage caused by:
- Force majeure events (natural disasters, war, weather conditions)
- Customs inspections or delays
- Client’s failure to provide documents
- Poor packaging
- Acts of third-party carriers beyond the Company’s control
2 Limitation of Liability
- Liability is limited according to applicable international conventions such as:
- Montreal Convention (air shipments)
- Hague-Visby Rules or Hamburg Rules (sea shipments)
- The Company is not responsible for consequential losses, loss of profit, 
   or indirect damages.
Delivery & Delays
- Delivery times are estimated and not guaranteed unless specifically agreed in writing.
- The Company is not responsible for delays due to:
- Customs clearance
- Port or airport congestion
- Weather conditions
- Incorrect documentation or receiver unavailability
Insurance
- Shipping charges do not include insurance.
- Insurance is available upon the Client’s request and at an additional cost.
- The Company is not liable for loss or damage to uninsured shipments.
Fees & Charges
The Client agrees to pay:
- Freight charges
- Handling, storage, demurrage, or detention fees
- Customs duties, taxes, inspection charges
- Any additional costs incurred due to Client delays or incorrect information
Claims & Complaints
- Any claim must be submitted in writing within:
- 48 hours of delivery for damage
- 7 days after expected delivery date for loss
- Claims must include supporting documents:
  1- Photos
  2- Commercial invoices
  3- Packing list
  4- Original packaging and airway bill / bill of lading
Undeliverable Shipments
If the receiver cannot be contacted or refuses delivery, the Company may:
1- Return the shipment to the sender at their cost
2- Store the shipment and charge storage fees
3- Dispose of or sell the shipment after reasonable notice to recover costs
Governing Law & Dispute Resolution
- Parties shall first attempt to resolve disputes amicably.
- If unresolved, disputes will be settled through arbitration or by courts of the,
   jurisdiction in which the Company operates.
General Provisions
- These Terms & Conditions may be updated by the Company at any time.
- By using the Company’s services, the Client agrees to all the above terms.
